General Terms and Conditions (GTC) for Margency

Scope

These General Terms and Conditions apply to all contracts, deliveries and services between Margency, represented by Maninder Singh, and its clients in the field of personnel services, in particular recruitment, HR consulting and support, and employer branding.

Deviating terms and conditions of the customer shall only apply if they have been expressly accepted in writing by Margency.

Services

Margency provides HR consulting and support services as well as employer branding in accordance with individual agreements with the client.

The specific services and their scope are determined from the respective contract or order confirmation.

Offer and conclusion of contract

Margency’s offers are subject to change and non-binding.

A contract is only concluded through a written order confirmation or through the actual performance of the services.

Remuneration

The remuneration for the services provided by Margency is based on the individual agreements between Margency and the customer.

All prices are subject to statutory VAT.

Payments are due within 14 days of invoicing without deduction.

Liability

Margency is liable for intent or gross negligence in accordance with statutory provisions.

Margency is only liable for slight negligence in the event of a breach of essential contractual obligations, the fulfilment of which is essential for the proper execution of the contract and on whose compliance the customer regularly relies (cardinal obligations).

Margency’s liability is limited to the typical, foreseeable damages.

Privacy policy

Margency undertakes to comply with data protection regulations and to treat the data provided by the customer confidentially.

Personal data will only be used for the purpose of executing the order and will not be passed on to third parties unless the customer has given their express consent or there is a legal obligation to do so.

Final provisions

Changes or additions to these General Terms and Conditions must be made in writing.

Should individual provisions of these General Terms and Conditions be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction for all disputes arising from or in connection with this contract is [place], provided that the customer is a merchant, a legal entity under public law or a special fund under public law.

These General Terms and Conditions take effect on February 1, 2024, and remain valid until revoked. Margency reserves the right to change or supplement these Terms and Conditions at any time. Any changes will be communicated to the customer in writing and in a timely manner.
